Physio Connection Terms of Service

Effective April 2nd, 2021

Welcome to Physio Connection, the leading Canadian network of physiotherapists that provide online pain management. Please read these terms carefully before accessing or using our website.

9436-8313 Québec inc. is the owner and operator of Physio Connection and https://physioconnection.ca/. The terms and conditions set forth (the "Terms") apply to all sites and mobile applications (the “Site” or the “Website”), as well as the network of physiotherapists (the “Network”) that are the property of 9436-8313 Québec inc. ("Physio Connection", "We", "Us"). By using the Site and the Network, you agree to these Terms of Service. If you do not agree, do not use the Site or the Network. We may modify these Terms at any time. Such modifications shall be effective immediately upon posting on the Site. You agree to review these Terms periodically and your continued access and use of the Site shall be deemed as your continued acceptance of the Terms.

Physio Connection provides the Site and the Network and related information "as is". You agree to assume total responsibility and risk for the use of the Site and the Internet. We do not make any warranties, endorsements or representations whatsoever with regard to the information provided through the Site, the Network or the Internet generally. It is your responsibility to evaluate the accuracy and completeness of the information provided through the site or on the Internet in general. Physio Connection shall not be liable for any cost or damage arising from your understanding or interpretation of this information.

Physio Connection is a company providing a Network via a Site, that allows members of the public (the “Users”), to directly book a virtual physiotherapy appointment (the “Services”) with members of the Network. The members of the Network that are available to provide the Services are independent contractors and are screened to ensure that they hold adequate qualifications to provide physiotherapy services (“the Physiotherapists”). Our Physiotherapists will use different software to provide their Services, such as Zoom for Healthcare, Embodia and Typeform, to provide and collect standard forms and questionnaires, provide an online Physiotherapy assessment or treatment, and/or to summarize treatment plan, whether by video call, audio call or text messages (the “Consultations”). Our Website and our Network are accessible through a web browser.

By accessing or using the Website or the Network or by being provided with any of our Services, you agree to be bound by these terms (the “Terms of Service”). You should also read our Privacy Policy, which is incorporated by reference into these Terms of Service. By using the site, you agree to these Terms of Service. If you do not agree, do not use the Site or the Network.

You must also read and complete the Consent Form before receiving a Service from a Physiotherapist. The Consent Form notably describes the risks and limitations of online physiotherapy services and has for purposes to your consent to care via online physiotherapy services.

Physio Connection may update or revise these Terms of Service from time to time and if your rights change, we will always notify you and our Users of this. If you do not agree to, or cannot comply with, the Terms of Service as revised, your sole recourse is to terminate your use of the Network or the Website. You will be deemed to have accepted the Terms of Service as amended if you continue to use the Network or the Website after any amendments are made.

1. Access to the Network

We hereby grant you permission to access and use the Site and the Network, solely for your personal non-commercial purposes and only as permitted by these Terms of Service with the main purposes to access our Services (as defined below).

Thus, we may suspend your access to the Network if your use of Services breaches any of these Terms of Service. In addition, we may withdraw, suspend, discontinue any functionality or feature of the Network, the Site or Services for any reasons, notably if our Network or is affected by any unforeseeable and irresistible event, including external causes with the same characteristics.

Technical or security threats or issues affecting the Network, or the Site may require us to suspend our Services in order to ensure they are secure and/or operating optimally. We are not responsible to you if this happens, but if it does, we will notify you as soon as we can and take the steps that we reasonably can to minimize the interruption to the Network access and to our Services.

2. Provision of the Services through the Network

Three types of Services will be provided to you through your access to the Network:

2.1 Online Physiotherapy Services

The term “online physiotherapy services” refers to physiotherapy services provided at a distance using information and communications technologies, such as interactive messaging, audio and video technology. The Network allows you to access quality physiotherapy services (the “Online Physiotherapy Services”) from licensed or accredited Physiotherapists, via an online consultation, whether by audio or video (“Online Consultation”). Our Online Consultations, where available, are provided using Healthcare Professionals duly licensed in Canada in their province and/or territory of practice and when required, in your province and/or territory of residence.

During an Online Consultation on the Network, you and the Physiotherapist will discuss your medical history, your symptoms, and any tests or treatment that you may require. The Physiotherapist may use the communication and interactive features of the communication services they use, to assess your condition and may prescribe a treatment to you, order tests or refer you to another healthcare provider for in-person examination, treatment or follow-up care.

Online physiotherapy is convenient and promotes access to healthcare. However, please note that there are certain limitations and potential risks associated with telemedicine, including, but not limited to, the following:

Online physiotherapy is dependent on broadband infrastructure and therefore, Online Consultations are susceptible to degradation or loss of connection;
Not all health conditions can be adequately assessed through online physiotherapy due to technological limitations. Therefore, you should always seek advice from a medical practitioner or healthcare practitioner in person if you are unsure about whether you have been able to explain or communicate your medical needs through our Online Physiotherapy Services in an appropriate manner, or if you have any concerns about the advice you receive from us;
The Network and any of our Online Physiotherapy Services are not intended to replace your existing healthcare providers, such as your family doctor. All our Physiotherapists are duly registered and licensed with the applicable regulatory body in their province and/or territory of practice and have committed to provide Services in accordance with best practice and applicable professional standards, however they may not have access to your up-to-date medical records, which may result in an inaccurate assessment and/or treatment plan; and
Although Physio Connection protects your personal information and personal health information through integrated physical, technological and administrative safeguards, there is no guarantee against data breaches, which may result in the unauthorized collection, use and/or disclosure of your personal health information.
The Network is not intended to be used and shall NOT be used for medical emergencies. If you have a medical emergency, you must immediately contact the emergency services in your area or go to the nearest hospital or healthcare center.

2.2 Online Pain management coaching

The term “online pain management coaching” refers to pain management coaching services provided at a distance using information and communications technologies, such as interactive messaging, audio and video technology. The Network allows you to access quality pain management coaching services (the “Online Pain Management Coaching”) from licensed or accredited Physiotherapists, via an online consultation, whether by audio or video (“Online Coaching”). Our Online Coaching, where available, are provided using Healthcare Professionals duly licensed in Canada in their province and/or territory of practice and when required, in your province and/or territory of residence.

THE ONLINE PAIN MANAGEMENT COACHING IS NOT AN ONLINE PHYSIOTHERAPY SERVICE.

During an Online Coaching on the Network, you and the Physiotherapist will discuss your medical history, your symptoms, and any tests or treatment that you may require. The Physiotherapist may use the communication and interactive features of the communication services they use, to assess your condition and may prescribe a treatment to you, order tests or refer you to another healthcare provider for in-person examination, treatment or follow-up care.

Although Physio Connection protects your personal information and personal health information through integrated physical, technological and administrative safeguards, there is no guarantee against data breaches, which may result in the unauthorized collection, use and/or disclosure of your personal health information.
The Network is not intended to be used and shall NOT be used for medical emergencies. If you have a medical emergency, you must immediately contact the emergency services in your area or go to the nearest hospital or healthcare center.

2.3 Orientation Services

Orientation services refer to the services provided by Physio Connection that are not healthcare-related, such as a technical presentation of the Online Physiotherapy Services or guidance on how to setup and access Online Physiotherapy Services. The Network allows you to access quality orientation services (the “Orientation Services”) from a Company administrator, technician or receptionist (each, for the purposes of these Terms of Service, a “Orientation Professional”) via an Orientation call (“Orientation Call”). The Orientation Services is not medical or healthcare-related advise and the Orientation Professional will not discuss medical or healthcare-related information directly. During an Orientation Call on the Network, you and the Orientation Professional will discuss information about the Services provided by the Company and the Orientation Professional will attempt to answer any of the question a User might have. The Orientation Professional may use the communication and interactive features of the Network or external video or audio communications software to assist you.

PLEASE ALSO NOTE THAT PHYSIO CONNECTION ONLY PROVIDES THE NETWORK (AND RELATED TECHNOLOGY) THAT CONNECTS YOU WITH OUR PHYSIOTHERAPISTS. THE PHYSIOTHERAPISTS ARE SOLELY RESPONSIBLE FOR AND HAVE COMPLETE CONTROL, AUTHORITY AND SUPERVISION OVER ALL ONLINE PAIN MANAGEMENT COACHING SERVICES PROVIDED TO YOU ON THE NETWORK, INCLUDING, BUT NOT LIMITED TO ADVICE, COACHING AND ANY OTHER PROCEDURES THAT COULD BE PROVIDED THROUGH THE NETWORK. PHYSIO CONNECTION DOES NOT SUPERVISE OR HAVE ANY CONTROL OVER THE PROVISION OF PAIN MANAGEMENT COACHING SERVICES BY THE PHYSIOTHERAPISTS, THE MATERIALS, TOOLS OR METHODS USED BY A PHYSIOTHERAPIST, THE COACHING PROVIDED BY A PHYSIOTHERAPIST OR THE CONDUCT OF A PHYSIOTHERAPIST. NEITHER PHYSIO CONNECTION NOR ANY OF ITS AFFILIATED COMPANIES OR PARTNERS SHALL BE HELD LIABLE FOR ANY ONLINE PHYSIOTHERAPY SERVICES PROVIDED TO YOU BY A PHYSIOTHERAPIST.

Quality and Complaints

Our Services are provided by appropriately qualified and experienced Physiotherapists. If you are not satisfied with the Services provided or should you wish to make a formal complaint about our Services, our Site or the Network, please do so as soon as possible following the event by contacting us via the Site or by email at info@physioconnection.ca. In case of any complaints related to our Services, we may require additional details and written consent from you in order for our clinical quality department to address it, in accordance with any applicable laws or regulatory requirements. All complaints related to our Physiotherapists will be handled with respect for the confidentiality of our Users information and their right to privacy; and in accordance with the rules applicable to these Physiotherapists as per their relevant regulatory body. In case of any disputes, please refer to Section 8 of these Terms. All disputes between you and a Physiotherapist are between you and such professional and not with us. Under no circumstances do we have an obligation to resolve any dispute or provide a refund to you (in such case that the Services were paid by you directly).

3. User Accounts on the Network

Primary Holders

In order to use the Network and be provided with the Services, you must access the Site and book Services with one of our Physiotherapists. To book a Service, you must be aged 14 years or older.

As part of the reservation process, you will be required to provide us with certain information about you and/or your eligible child(ren), such as full name, email address, phone number. You may also be required to provide us with payment and banking information to facilitate payments for Services. Please refer to Section 5 regarding the collection and processing of any of your personal information by Physio Connection for more details.

You agree that you will provide accurate, current and complete information about yourself and promptly update all information to ensure that your information is accurate, current and complete. You may update or change your reservation information at any time.

You are not permitted to transfer or sell your reservation to any other person nor provide any other person with access to your reservation as further provided in these Terms of Service.

Minors and Dependents

A child aged less than 14 years old (a “Minor”) or a child/spouse who lacks the necessary capacity to give valid consent to his or her physiotherapy treatment (each, being referred to herein as a “Dependent”) is not permitted to make a reservation. However, Dependents may receive Services via the Network through their parent’s or legal guardian’s reservation, provided that the parent or legal guardian is with the Dependent when the Dependent is using the Services and that the parent or legal guardian have given their consent to the Physiotherapist. If you use your reservation to obtain Services for your Dependent, you are responsible for complying with these Terms of Service.

Please note that you shall not use the Site (i) to obtain Services for any of the Primary Holder’s Dependents if you are yourself the child of a Primary Holder unless you are a legal guardian of the Dependent; (ii) if you are the sibling or child of a Dependent and you use your reservation for that Dependent solely on the basis of your family relationship to the Dependent.

All Physiotherapists reserve their right to assess whether a person has the capacity to provide consent to his or her medical treatment on a case-by-case basis. If the Physiotherapist determines that a person is a Dependent, the Dependent’s parent or legal guardian must abide by the terms defined in the preceding two paragraphs whenever the Dependent receives the Services.

4. Confidentiality

You agree that except as otherwise disclosed or scheduled with the Physiotherapist prior to any provision of Services or any Consultations or as provided in these Terms of Service, you will only use the Services for your benefit and will not use the Services for the benefit of a third party.

5. Privacy and Communications

By accessing or using the Network and in order to provide you with the access to the Network and the Services, you understand that we will need and will collect and use certain information about you, including your personal information and personal health information as defined in, and in accordance with, our Privacy Policy. Please take the time to read it as it includes important details about how we collect and process your personal information.

For more information about our collection, use, disclosure and protection of your personal information, please read our Privacy Policy. Questions or requests with respect to your personal information may be sent via email to info@physioconnection.ca.

We may send you certain communications in connection with your use of the Network and your request for Services. For example, we may send you reminders of your Consultations, administrative notices and other information about your use of the Network. We will always send you communications containing your personal health information through our secure electronic medical records software. We will also try to send any other communications to you via secure channels. However, when we are unable to contact you via secure channels, we may be required to use an unsecured message or contact a family member in order to provide safe care. Unsecured messages or messages to family members will only include a request for you to contact us through our secure Network.

We may also send you certain communications to evaluate the quality of the Services received. By using our Services and providing your email address, you consent to being contacted for quality evaluation purposes. You. may opt out of this service at any point, by using the “unsubscribe” link at the bottom of such communication email or by contacting us at info@physioconnection.ca.

6. Appropriate Use of the Network and the Services

The Network

Your use of the Network is subject to all applicable local, provincial/territorial and federal laws and regulations. Unless you have been specifically permitted to do so in a separate agreement with us, you agree that you will not reproduce, reverse engineer, duplicate, copy, sell, trade or resell any features of the Network or any of our products and services for any purpose.

YOU AGREE THAT YOU WILL NOT RECORD AND/OR DISTRIBUTE IN ANY WAY, MANNER OR FORM ANY CONSULTATIONS WITHOUT OUR PRIOR WRITTEN AUTHORIZATION.

In addition, you agree that you will not use the Network to:

Promote or engage in any unlawful or illegal activities or internet abuse, including unsolicited advertising and spam;
Promote, upload, post, or otherwise make available any material that is abusive, harassing, obscene, vulgar, hateful, invasive of another’s privacy, defamatory or otherwise objectionable or illegal, or that discriminates based on race, gender, religion, nationality, disability, sexual orientation, age, family status or any other legally protected class. We will not tolerate any abuse or offensive discourse or behaviour towards our employees or our Physiotherapists as further described below;
Upload, post or otherwise make available any material that contains viruses, malware or other malicious software;
Upload, post, or otherwise make available any material that you do not have a right to make available or that infringes any patent, trade-mark, trade secret, copyright or other proprietary rights of any person. You shall be solely liable for any damage resulting from any infringement of the intellectual property of any third-party;
Make any false representation, including impersonation of any person or entity or misrepresentation of your affiliation with any person or entity;
Engage in any activity that interferes with or disrupts the use of the Network, including bypassing any measures we may use to prevent unauthorized access to the Network;
Engage in any activity that attempts to extract any proprietary software used to maintain the Network; or
Track, trace or harvest any information on any person who visits the Network.

You agree that you are solely responsible for (and that we have no responsibility to you or to any third party for) any breach of your obligations under these Terms of Service and for the consequences (including any loss or damage which we may suffer) of any such breach. In addition, Physio Connection reserves the right to investigate, suspend and/or terminate your access to the Network if you engage in any of the above activities, misuse the Network or otherwise engage in acts that Physio Connection regards as inappropriate or unlawful.

You agree that no email address found on the Network may be harvested or otherwise used for purposes of solicitation.

The Services

Except as otherwise mentioned or agreed by Physio Connection in writing, the Services are for use in Canada only. We do not take responsibility for laws outside of Canada governing access to our Services and if you use them elsewhere you should check in that country or region that it is appropriate and lawful for you to do so. We provide our services in compliance with Canadian law and regulation, and cannot take responsibility for any differences between those rules and any different rules applying to healthcare services anywhere else.

You are solely responsible for ensuring that you use the Network in accordance with these Terms of Service in the jurisdiction where you are located at the time of a Consultation and as permitted by that jurisdiction’s law or regulation.

BY SELECTING A PROVINCE WHEN BOOKING AN APPOINTMENT, YOU CONFIRM THAT YOU LIVE IN THAT PROVINCE. Our Physiotherapists are regulated provincially and, as such, can only provide Online Physiotherapy Services in specific regions. Physio Connection will not be held responsible in the event where you mislead or attempt to mislead a Physiotherapist into providing Online Physiotherapy Services in a province where they are not registered. Physio Connection will only allow you to book with Physiotherapist in the province(s) where they are registered. You are responsible for providing accurate information when booking an appointment and must select the province that you live in.

Our Physiotherapists have the discretion to refuse or discontinue the provision of Online Physiotherapy Services to any Users at any time, including for actual or potential misuse of the Online Physiotherapy Services, notably in light of these Terms of Service.

Communicating with employees and Physiotherapists

You acknowledge and agree that you will refrain from inappropriate language or conduct when communicating with Physio Connection employees and Physiotherapists, regardless of whether or not that language or conduct is specifically directed at the individual you are communicating with. Inappropriate language includes but is not limited to speech that is abusive, harassing, vulgar, hateful or defamatory, or which discriminates against other persons on the basis of gender, race, religion, ethnicity, sexual orientation, family status or disability. You also agree that you will not attempt to communicate with any Physio Connection employee or Physiotherapist through any means other than the Network, except when mutually agreed or if instructed to by a Physio Connection employee.

7. Payments of charges and cancellation fees

Additional charges

You may access and use the Network through the Site loaded onto a mobile device or via a web browser. You are solely responsible for any software requirements and for any data charges and fees associated with accessing and using the Network.

When you want to obtain a Service that is a Consultation with any Physiotherapist, you and the Physiotherapist providing that Consultation are entering into a direct business relationship with each other. We will facilitate and process the payment of the applicable Charges for a Consultation on behalf of such Physiotherapist. The payment of the Charges in this manner is considered to be the same as you directly making the payment to said professional.

If you are paying the Charges for a Service, you must provide us with valid credit card information as the form of payment. If that Service is eligible for an insurance receipt, we will provide you with one.

We are not responsible for exchange rate fluctuations or for any processing fees charged by your payment provider or financial institution.

YOU AGREE THAT YOU WILL PAY THE PHYSIOTHERAPIST FOR A CONSULTATION THROUGH OUR SITE AND THAT YOU WILL NOT PAY ANY PHYSIOTHERAPIST DIRECTLY FOR A CONSULTATION. ALL PAYMENTS MUST BE MADE THROUGH PHYSIO CONNECTION.

Cancellation Fees

Please be advised that cancellations or rescheduling made up to forty-eight (48) hours before a scheduled appointment, by contacting the Physiotherapist or using the rescheduling option in the confirmation email received, will be processed without a penalty.

Cancellations or rescheduling made forty-eight (48) hours or less before an appointment will be subject to a charge of 50% of the Service Charge.

Physio Connection reserves the right to cancel your appointment if (i) you are more than 5 minutes late, (ii) if your environment is not safe or private, or (iii) if communication is not secure.

In the event that you are experiencing technical issues before or during your appointment, resulting in you not being able to connect or re-connect, it is your responsibility to email or call the Physiotherapist providing you with a Service to inform them of the situation. The Physiotherapist will evaluate the situation and will direct you with regards to the next steps.

8. Links to Third-Party Sites and Third-Party Information

Use of certain links on the Network will direct you away from the Network to third party websites. Such third-party websites are not under our control, and we are not responsible for the contents of any such website, or any link contained in such website. The third-party links included on the Network are provided for your convenience, and the inclusion of such links does not imply a recommendation or endorsement by us of any such website or the products or services offered therein. If you decide to access any of the third-party websites, you do so entirely at your own risk. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with the use of or reliance on any such third-party websites.

Any third-party content, data or publications made available through the Network are furnished by us on an as-is basis for your convenience and information. Any opinions, advice, statements, services, offers, or other information made available by third parties, including Physiotherapists, information providers, or any user of the Network, are those of the respective author(s) or publisher(s) and not of us. WE DISCLAIM ANY WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED, THAT THE INFORMATION IN SUCH PUBLICATIONS IS ACCURATE OR COMPLETE.

9. Ownership of Intellectual Property Rights

The contents of the Website and the Network include, without limitation, all information, data, products, materials, services, software applications and tools, design elements, text, images, photographs, illustrations, audio and video contents, artwork and graphics contained therein or otherwise made available to you in connection therewith (collectively the “Contents”) and, unless the context clearly requires otherwise, or we explicitly say so in writing, the terms “Network”, “Website” and “Site” include all of the Contents.

The Website and the Network together with all trademarks and other intellectual property displayed, distributed, or otherwise made available via the Website and the Network, are the exclusive property of Physio Connection, and its successors, assigns, licensors, and/or suppliers. Unless you have agreed otherwise in writing with us, nothing in these Terms of Service gives you a right to use any of the Contents, our trademarks or other intellectual property of Physio Connection. You may not assign or transfer any of the Contents and you may not grant a license to use or access the Website and the Network to any party.

No information or statement contained in these Terms of Service, the Website or the Network shall be construed as conferring, directly or by implication, estoppel or otherwise, any license or right under any patent, copyright, trademark, or other intellectual property right of Physio Connection or any third party. You must not alter, delete, or conceal any copyright or other notices contained on the Website or the Network, including notices on any of the Contents that you are permitted to download, transmit, display, print, or reproduce from the Website or the Network.

Any unauthorized or prohibited use of any Contents may subject you to civil liability, criminal prosecution, or both, under applicable federal, provincial, state and local laws.

You may not create a link to the Website or the Network without our prior permission. We may, however, if requested, grant a limited, non-exclusive right to create a link to the Website or the Network provided that such link is to the entry page of the Website or the Network and does not portray us or any of our activities or services in a false, misleading, derogatory, or otherwise negative manner.

The limited rights granted to you under these Terms of Service may be revoked by us at any time for any reason whatsoever.

10. Termination and Cancellation

We may terminate your use of the Network as contemplated above, notably in case of breach or non-compliance by you of these Terms of Service. We may also terminate access to the Contents, features, functionality, products and services made available in connection therewith, at any time and for any reason, with or without cause, without prior notice to you and without any liability.

If you want to stop using our Services, you may do so by cancelling any remaining any appointments you might still have, and stop using our Site or Network. Subject to any applicable laws and the ethical and professional obligations of the Physiotherapist(s) providing Online Physiotherapy Services to you, we will have no further obligation of any kind whatsoever to you or any other party. We reserve the right to preserve, retain or delete your information, including personal information, in accordance with the Privacy Policy and any applicable laws and regulations.

11. Warranty Disclaimer

SOME PROVINCES AND TERRITORIES DO NOT ALLOW FOR THE EXCLUSION OF WARRANTIES (INCLUDING THE PROVINCE OF QUEBEC). IN THESE PROVINCES AND TERRITORIES, YOU HAVE ONLY THE WARRANTIES THAT ARE EXPRESSLY REQUIRED TO BE PROVIDED IN ACCORDANCE WITH APPLICABLE LAW. IN ALL OTHER PROVINCES AND TERRITORIES, EXCEPT AS EXPRESSLY PROVIDED HEREIN, YOUR USE OF THE NETWORK IS PROVIDED TO YOU “AS IS” AND “AS AVAILABLE”. WE EXPRESSLY DISCLAIM ALL OTHER REPRESENTATIONS, WARRANTIES, AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATION, WARRANTY OR CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM A COURSE OF DEALING, PERFORMANCE, OR TRADE USAGE. YOUR SOLE AND EXCLUSIVE REMEDY, AND OUR SOLE OBLIGATION TO YOU OR ANY THIRD PARTY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE NETWORK, IS THAT YOU ARE FREE TO DISCONTINUE YOUR USE OF THE NETWORK AT ANY TIME.

12. Limitation of Liability

SOME PROVINCES AND TERRITORIES DO NOT PROVIDE EXCLUSION OF LIMITATION OF LIABILITY FOR ALL TYPES OF DAMAGES (INCLUDING THE PROVINCE OF QUEBEC). IN THOSE PROVINCES, WE WILL ONLY BE LIABLE TO YOU FOR DAMAGES THAT WE ARE EXPRESSLY REQUIRED TO BE LIABLE TO YOU UNDER APPLICABLE LAW.

IN ANY OTHER CASE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU IN CONNECTION WITH YOUR USE OF THE NETWORK, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY INCLUDING, BUT NOT LIMITED TO, ANY BUSINESS LOSSES, LOSS OF PROFIT, LOST OPPORTUNITIES, LOSS OF DATA SUFFERED, OR OTHER INTANGIBLE LOSS. THE LIMITATIONS ON OUR LIABILITY TO YOU IN THIS SECTION SHALL APPLY WHETHER OR NOT WE HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

13. Connectivity

IN NO EVENT WILL PHYSIO CONNECTION BE LIABLE FOR DELAYS, INTERRUPTIONS, SERVICE FAILURES, OR OTHER PROBLEMS INHERENT IN USE OF THE INTERNET, ELECTRONIC COMMUNICATIONS, TELECOMMUNICATIONS NETWORKS OR OTHER SYSTEMS OR NETWORKS OUTSIDE OUR REASONABLE CONTROL.

14. Indemnification

You agree to indemnify and hold us, our affiliated companies and their respective agents, employees, directors and officers, harmless from any claim or demand, cause of action, liabilities and expenses (including reasonable lawyer’s fees) due to or arising out of: (i) your use of the Network; (ii) your violation of these Terms of Service; (iii) any misrepresentations made by you; or (iv) your violation of any rights of a third party in connection with your use of the Website, the Network or the Services.

15. General

These Terms of Service and the Privacy Policy, constitute the entire agreement between you and Physio Connection relating to your use and our provision of the Website and the Network.

You agree that we may provide you with notices, including those regarding changes to these Terms of Service, by email, regular mail, or postings on the Website or the Network.

You agree that if we do not exercise or enforce any legal right or remedy which is contained in these Terms of Service (or which we have the benefit of under any applicable law), this will not be taken to be a formal waiver of our rights and that those rights or remedies will still be available to us.

If any provision of these Terms of Service is held to be illegal, invalid or unenforceable, this will not affect any other provision of these Terms of Service and the agreement between you and us will be deemed amended to the extent necessary to make it legal, valid, and enforceable.

16. Obtaining Physio Connection Consent

To request our consent for any of the actions for which such consent is required under these Terms of Service, please send us an email to info@physioconnection.ca. We reserve the right to refuse any such requests at our sole discretion.

17. Applicable laws and competent jurisdiction

THE LAWS OF THE PROVINCE OF QUEBEC AND THE FEDERAL LAWS APPLICABLE THEREIN SHALL GOVERN THESE TERMS OF SERVICE IN ALL RESPECTS.

YOU HEREBY ACKNOWLEDGE THAT THE COURTS OF THE PROVINCE OR TERRITORY IN WHICH YOU ARE LOCATED AT THE TIME THE ONLINE PHYSIOTHERAPY SERVICES OR THE ORIENTATION SERVICES ARE PROVIDED TO YOU SHALL HAVE EXCLUSIVE JURISDICTION TO HEAR ANY COMPLAINT, CLAIM, DEMAND, PROCEEDING OR CAUSE OF ACTION WHATSOEVER ARISING OUT OF OR RELATING TO SUCH PHYSIOTHERAPY CARE AND TREATMENT OR ADVICE RECEIVED, OR ANY OTHER ASPECT OF THE RELATIONSHIP BETWEEN YOU AND THE CORRESPONDING PHYSIOTHERAPIST.

ANY OTHER DISPUTE RELATING TO THESETERMS OF SERVICEOR THE USE OF THE NETWORK SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF MONTREAL, PROVINCE OF QUEBEC

9436-8313 Québec inc. est le propriétaire et l'exploitant de Physio Connection et de https://physioconnection.ca/. Les conditions énoncées (les " Conditions ") s'appliquent à tous les sites et applications mobiles (le " Site " ou le " Site Web "), ainsi qu'au réseau de physiothérapeutes (le " Réseau ") qui sont la propriété de 9436-8313 Québec inc. Physio Connection est une société fournissant un Réseau via un Site, qui permet aux membres du public (les " Utilisateurs "), de prendre directement un rendez-vous virtuel de physiothérapie (les " Services ") avec les membres du Réseau. Les membres du Réseau qui sont disponibles pour fournir les services sont des entrepreneurs indépendants et sont sélectionnés pour s'assurer qu'ils possèdent les qualifications adéquates pour fournir des services de physiothérapie ("les Physiothérapeutes"). Nos Physiothérapeutes utiliseront différents logiciels pour fournir leurs services, tels que Zoom for Healthcare, Embodia et Typeform, pour fournir et recueillir des formulaires et des questionnaires standard, fournir une évaluation ou un traitement de physiothérapie en ligne, et/ou résumer le plan de traitement, que ce soit par appel vidéo, appel audio ou messages texte (les "Consultations"). Notre site Web et notre réseau sont accessibles via un navigateur Web.

En accédant ou en utilisant le site Web ou le Réseau, ou en bénéficiant de l'un de nos Services, vous acceptez d'être lié par les présentes conditions (les "Conditions de Service"). Physio Connection peut mettre à jour ou réviser ces Conditions de Service de temps à autre et si vos droits changent, nous vous en informerons toujours ainsi que nos Utilisateurs. Si vous n'acceptez pas ou ne pouvez pas vous conformer aux Conditions de Service telles que révisées, votre seul recours est de mettre fin à votre utilisation du Réseau ou du Site Internet. Vous serez réputé avoir accepté les Conditions de Service telles que modifiées si vous continuez à utiliser le Réseau ou le Site Internet après que des modifications ont été apportées.

1. Accès au Réseau

Nous vous accordons par la présente l'autorisation d'accéder et d'utiliser le Site et le Réseau, uniquement à des fins personnelles et non commerciales et dans la mesure permise par les présentes Conditions de Service, avec pour objectif principal d'accéder à nos Services (tels que définis ci-dessous).

Par conséquent, nous nous réservons le droit de suspendre votre accès au Réseau si votre utilisation de nos Services est en violation avec ces Conditions de Service. De plus, nous pourrions retirer, suspendre ou discontinuer toute fonctionnalité ou caractéristique du Réseau, du Site ou des Services pour quelque raison que ce soit, notamment si notre Réseau ou notre Site est affectée par un événement imprévisible et irrésistible, incluant toutes causes extérieures à notre contrôle avec les mêmes caractéristiques.

Certaines menaces ou problèmes techniques ou de sécurité affectant le Réseau ou le Site peuvent nous obliger à suspendre nos Services afin de nous assurer qu'ils sont sécuritaires et / ou fonctionnent de manière optimale. Nous ne sommes pas responsables envers vous si cela se produit, mais si tel est le cas, nous vous en informerons dès que possible et prendrons les mesures raisonnables pour minimiser l'interruption de l'accès au Réseau et à nos Services.

2. Fourniture des Services par le biais du Site

Trois types de Services vous seront offerts par le biais de votre accès au Site.

2.1 Services de physiothérapie en ligne

Le terme " Services de Physiothérapie en Ligne " désigne les services de physiothérapie fournis à distance au moyen des technologies de l'information et des communications, telles que la messagerie interactive et les technologies audio et vidéo. Le Réseau vous permet d'accéder à des services de physiothérapie de qualité (les " services de physiothérapie en ligne ") fournis par des Physiothérapeutes autorisés ou agréés, par le biais d'une consultation en ligne, qu'elle soit audio ou vidéo (" Consultation en ligne "). Nos Consultations en ligne, lorsqu'elles sont disponibles, sont fournies par des professionnels de la santé dûment autorisés au Canada dans leur province et/ou territoire d'exercice et, au besoin, dans votre province et/ou territoire de résidence.

Au cours d'une consultation en ligne sur le réseau, vous et le Physiothérapeute discuterez de vos antécédents médicaux, de vos symptômes et de tout test ou traitement dont vous pourriez avoir besoin. Le physiothérapeute peut utiliser les fonctions de communication et d'interactivité des services de communication qu'il utilise, pour évaluer votre état et peut vous prescrire un traitement, commander des tests ou vous adresser à un autre prestataire de soins de santé pour un examen, un traitement ou des soins de suivi en personne.

La physiothérapie en ligne est pratique et favorise l'accès aux soins de santé. Toutefois, veuillez noter que la télémédecine comporte certaines limites et des risques potentiels, notamment les suivants :

La physiothérapie en ligne dépend de l'infrastructure à bande large et, par conséquent, les Consultations peuvent être sujettes à la dégradation ou à la perte de connexion;
Toutes les conditions de santé ne peuvent pas être évaluées de manière adéquate grâce à la physiothérapie en ligne en raison des limites technologiques. Par conséquent, vous devriez toujours demander conseil à un médecin en personne si vous ne savez pas si vous avez été en mesure d'expliquer ou de communiquer vos besoins médicaux par le biais de nos Services de Physiothérapie en Ligne de manière appropriée, ou si vous avez des préoccupations concernant les conseils que vous recevez de notre part;
Le Réseau et tous nos Services de Physiothérapie en Ligne ne sont pas destinés à remplacer vos fournisseurs de soins de santé existants, tels que votre médecin de famille. Tous nos Physiothérapeutes sont dûment enregistrés et licenciés auprès de l'organisme de réglementation applicable dans leur province et / ou territoire d'exercice et se sont engagés à fournir des services conformément aux meilleures pratiques et aux normes professionnelles applicables, mais ils peuvent ne pas avoir accès à des dossiers médicaux à jour, ce qui peut entraîner une évaluation et / ou un plan de traitement inexacts; et
Bien que Physio Connection protège vos renseignements personnels et vos renseignements personnels de santé grâce à des mesures de protection physiques, technologiques et administratives intégrées, il n'y a aucune garantie contre les atteintes de données, qui peuvent entraîner la collecte, l'utilisation et / ou la divulgation non autorisées de vos renseignements personnels de santé.
Le Réseau n’est pas conçu pour être utilisé en cas d’urgence et ne devrait PAS être utilisé pour des urgences médicales. Si vous avez une urgence médicale, vous devez communiquer avec les services d’urgence de votre secteur ou vous rendre à l’hôpital ou au centre de santé le plus proche.

2.2 Services de gestion de la douleur en ligne

Le terme " Services de Gestion de la Douleur en Ligne " désigne les services de gestion de la douleur fournis à distance au moyen des technologies de l'information et des communications, telles que la messagerie interactive et les technologies audio et vidéo. Le Réseau vous permet d'accéder à des services de gestion de la douleur de qualité (les " services de gestion de la douleur en ligne ") fournis par des Physiothérapeutes autorisés ou agréés, par le biais d'une consultation en ligne, qu'elle soit audio ou vidéo (" Séance de Coaching en ligne "). Nos Séances de Coaching en ligne, lorsqu'elles sont disponibles, sont fournies par des professionnels de la santé dûment autorisés au Canada dans leur province et/ou territoire d'exercice et, au besoin, dans votre province et/ou territoire de résidence.

Au cours d'une Séance de Coaching en ligne sur le réseau, vous et le Physiothérapeute discuterez de vos antécédents médicaux, de vos symptômes et de tout test ou traitement dont vous pourriez avoir besoin. Le physiothérapeute peut utiliser les fonctions de communication et d'interactivité des services de communication qu'il utilise, pour évaluer votre état et peut vous prescrire un traitement, commander des tests ou vous adresser à un autre prestataire de soins de santé pour un examen, un traitement ou des soins de suivi en personne.

La gestion de la douleur en ligne est pratique et favorise l'accès aux soins de santé. Toutefois, veuillez noter que cette approche comporte certaines limites et des risques potentiels, notamment les suivants :

La physiothérapie en ligne dépend de l'infrastructure à bande large et, par conséquent, les Séances de Coaching peuvent être sujettes à la dégradation ou à la perte de connexion;

Bien que Physio Connection protège vos renseignements personnels et vos renseignements personnels de santé grâce à des mesures de protection physiques, technologiques et administratives intégrées, il n'y a aucune garantie contre les atteintes de données, qui peuvent entraîner la collecte, l'utilisation et / ou la divulgation non autorisées de vos renseignements personnels de santé.

2.3 Les Services d’orientation

Les services d'orientation désignent les services fournis par Physio Connection qui ne sont pas liés aux soins de santé, tels qu'une présentation technique des Services de Physiothérapie en Ligne ou des conseils sur la façon de configurer et d'accéder aux Services de Physiothérapie en Ligne. Le Réseau vous permet d'accéder à des Services d'orientation de qualité (les " Services d'orientation ") fournis par un administrateur, un technicien ou un réceptionniste de la Société (chacun, aux fins des présentes Conditions de Service, étant un " Professionnel de l'orientation ") par le biais d'un appel d'orientation (" Appel d'orientation "). Les Services d'orientation ne sont pas des conseils médicaux ou liés aux soins de santé et le Professionnel de l'orientation ne discutera pas directement d'informations médicales ou liées aux soins de santé. Au cours d'un Appel d'orientation sur le Réseau, vous et le Professionnel de l'orientation discuterez des informations sur les services fournis par la société et le Professionnel de l'orientation tentera de répondre à toutes les questions qu'un utilisateur pourrait avoir. Le Professionnel de l'orientation peut utiliser les fonctions de communication et d'interaction du réseau ou un logiciel de communication vidéo ou audio externe pour vous aider.

VEUILLEZ ÉGALEMENT NOTER QUE PHYSIO CONNECTION FOURNIT UNIQUEMENT LE RÉSEAU (ET LA TECHNOLOGIE ASSOCIÉE) QUI VOUS MET EN RELATION AVEC NOS PHYSIOTHÉRAPEUTES. LES PHYSIOTHÉRAPEUTES SONT LES SEULS RESPONSABLES ET ONT LE CONTRÔLE, L'AUTORITÉ ET LA SUPERVISION COMPLETS DE TOUS LES SERVICES DE PHYSIOTHÉRAPIE EN LIGNE QUI VOUS SONT FOURNIS SUR LE RÉSEAU, Y COMPRIS, MAIS SANS S'Y LIMITER, LES CONSEILS DE PHYSIOTHÉRAPIE, LE DIAGNOSTIC, LE TRAITEMENT ET TOUTE AUTRE PROCÉDURE QUI POURRAIT ÊTRE FOURNIE PAR LE BIAIS DU RÉSEAU OU DES CONSULTATIONS. PHYSIO CONNECTION NE SUPERVISE PAS ET N'A AUCUN CONTRÔLE SUR LA PRESTATION DES SERVICES DE PHYSIOTHÉRAPIE PAR LES PHYSIOTHÉRAPEUTES, SUR LES MATÉRIAUX, OUTILS OU MÉTHODES UTILISÉS PAR UN PHYSIOTHÉRAPEUTE, SUR LE TRAITEMENT FOURNI PAR UN PHYSIOTHÉRAPEUTE OU SUR LA CONDUITE D'UN PHYSIOTHÉRAPEUTE. NI PHYSIO CONNECTION NI AUCUNE DE SES SOCIÉTÉS AFFILIÉES OU PARTENAIRES NE PEUVENT ÊTRE TENUS RESPONSABLES DES SERVICES DE PHYSIOTHÉRAPIE EN LIGNE QUI VOUS SONT FOURNIS PAR UN PHYSIOTHÉRAPEUTE.

Qualité et réclamations

Nos Services sont fournis par des Physiothérapeutes qualifiés et expérimentés. Si vous n'êtes pas satisfait des Services fournis ou si vous souhaitez déposer une plainte formelle concernant nos Services, notre Site ou notre Réseau, veuillez le faire dès que possible après l'événement en nous contactant par courriel à info@physioconnection.ca. En cas de réclamation relative à nos Services, nous pouvons exiger de votre part des détails supplémentaires et un consentement écrit afin que notre service de qualité clinique puisse y répondre, conformément à toutes les lois applicables ou exigences réglementaires. Toutes les plaintes relatives à nos Physiothérapeutes seront traitées dans le respect de la confidentialité des informations de nos Utilisateurs et de leur droit à la vie privée; et conformément aux règles applicables à ces Physiothérapeutes selon leur organisme de réglementation compétent.

Comme le précise le Formulaire de consentement, tous les litiges entre vous et un Physiothérapeute sont entre vous et ce professionnel et non avec nous. En aucun cas, nous n'avons l'obligation de résoudre un litige ou de vous rembourser (dans le cas où les Consultations ont été payées directement par vous).

3. Compte Utilisateur sur le Réseau

Titulaires primaires

Pour pouvoir utiliser le Réseau et bénéficier des Services, vous devez accéder au Site et réserver des Services auprès de l'un de nos Physiothérapeutes. Pour réserver un Service, vous devez être âgé de 14 ans ou plus.

Dans le cadre du processus de réservation, il vous sera demandé de nous fournir certaines informations sur vous et/ou votre/vos enfant(s) éligible(s), telles que votre nom complet, votre adresse électronique, votre numéro de téléphone. Il peut également vous être demandé de nous fournir des informations de paiement et bancaires afin de faciliter le paiement des services. Veuillez vous référer à la section 5 concernant la collecte et le traitement de vos informations personnelles par Physio Connection pour plus de détails.

Vous acceptez de fournir des informations exactes, actuelles et complètes sur vous-même et de mettre à jour rapidement toutes les informations afin de vous assurer que vos informations sont exactes, actuelles et complètes. Vous pouvez mettre à jour ou modifier vos informations de réservation à tout moment.

Vous n'êtes pas autorisé à transférer ou à vendre votre réservation à une autre personne, ni à permettre à une autre personne d'accéder à votre réservation, comme le prévoient les présentes conditions de service.

Mineurs et personnes à charge

Un enfant âgé de moins de 14 ans (un "Mineur") ou un enfant/conjoint qui n'a pas la capacité nécessaire pour donner un consentement valide à son traitement de physiothérapie (chacun étant désigné dans les présentes comme une "Personne à charge") n'est pas autorisé à effectuer une Réservation. Toutefois, les Personnes à charge peuvent recevoir des Services par l'intermédiaire du Réseau grâce à la réservation de leur parent ou de leur tuteur légal, à condition que le parent ou le tuteur légal soit avec la Personne à charge lorsque celle-ci utilise les Services et que le parent ou le tuteur légal ait donné son consentement au Physiothérapeute. Si vous utilisez votre réservation pour obtenir des Services pour votre Personne à charge, vous êtes tenu de vous conformer aux présentes conditions de service.

Veuillez noter que vous ne devez pas utiliser le Site (i) pour obtenir des Services pour l'une des Personnes à charge du titulaire principal si vous êtes vous-même l'enfant d'un titulaire principal, à moins que vous ne soyez le tuteur légal de la Personne à charge ; (ii) si vous êtes le frère, la sœur ou l'enfant d'une Personne à charge et que vous utilisez votre réservation pour cette Personne à charge uniquement en raison de votre lien de parenté avec la Personne à charge.

Tous les Physiothérapeutes se réservent le droit d'évaluer au cas par cas si une personne a la capacité de donner son consentement à son traitement médical. Si le Physiothérapeute détermine qu'une personne est une Personne à charge, le parent ou le tuteur légal de la personne à charge doit se conformer aux conditions définies dans les deux paragraphes précédents chaque fois que la Personne à charge reçoit les Services.

4. Confidentialité

Vous convenez que, sauf indication contraire divulguée ou prévue avec le Physiothérapeute avant toute prestation de Services ou toute Consultation ou comme prévu dans les présentes Conditions de service, vous n'utiliserez les Services qu'à votre profit et n'utiliserez pas les services au profit d'un tiers.

5. Communication et confidentialité des renseignements personnels.

En accédant ou en utilisant le Réseau et afin de vous fournir l'accès au Réseau et aux Services, vous comprenez que nous collecterons et utiliserons certains renseignements vous concernant, y compris vos renseignements personnels et vos renseignements personnels de santé telles que définies dans notre Politique de Confidentialité et conformément à celle-ci. Veuillez prendre le temps de la lire car elle contient des détails importants sur la manière dont nous collectons et traitons vos renseignements personnels.

Nous vous enverrons toujours des communications contenant vos renseignements personnels de santé via notre plateforme sécurisée ou à partir de notre logiciel sécurisé de dossiers médicaux électroniques. Nous essaierons également de vous envoyer toute autre communication via des canaux sécurisés. Cependant, lorsque nous ne pouvons pas vous contacter via des canaux sécurisés, nous pouvons être amenés à utiliser un message non sécurisé ou à contacter un membre de la famille afin de fournir des soins en toute sécurité. Les messages non sécurisés ou les messages adressés aux membres de la famille comprendront uniquement une demande vous demandant de nous contacter via notre Réseau.

Nous pouvons également vous envoyer certaines communications pour évaluer la qualité des Services reçus. En utilisant nos Services et en fournissant votre adresse électronique, vous acceptez d'être contacté à des fins d'évaluation de la qualité. Vous pouvez vous désinscrire de ce service à tout moment, en utilisant le lien "désinscription" figurant au bas d’un e-mail de communication ou en nous contactant à l'adresse info@physioconnection.ca.

6. Utilisation appropriée du Réseau et des Services

Le Réseau

Votre utilisation du Réseau est soumise à toutes les lois et réglementations locales, provinciales / territoriales et fédérales applicables. Sauf si vous avez été spécifiquement autorisé à le faire dans un accord séparé avec nous, vous acceptez de ne pas, peu importe l’objectif, reproduire, faire de l'ingénierie inverse, dupliquer, copier, vendre, échanger ou revendre les fonctionnalités du Réseau ou de l'un de nos produits et Services.

VOUS ACCEPTEZ DE NE PAS ENREGISTRER ET / OU DISTRIBUER DE QUELQUE MANIÈRE OU FORME QUE CE SOIT LES CONSULTATIONS SANS NOTRE AUTORISATION ÉCRITE PRÉALABLE.

De plus, vous acceptez de ne pas utiliser le Réseau pour:

Promouvoir ou vous engager dans des activités illégales ou des abus, y compris la publicité non sollicitée et les spams;
Promouvoir, télécharger, publier ou rendre disponible de quelque manière que ce soit tout matériel qui est abusif, harcelant, obscène, vulgaire, haineux, envahissant la vie privée d'autrui, diffamatoire ou autrement répréhensible ou illégal, ou qui est discriminatoire en fonction de la race, du sexe, de la religion, de la nationalité, du handicap, l'orientation sexuelle, l'âge, la situation familiale ou toute autre classe légalement protégée. Nous ne tolérerons aucun abus, discours ou comportement offensant envers nos employés ou les Physiothérapeutes comme décrit ci-dessous;
Télécharger, publier ou autrement rendre disponible tout matériel contenant des virus ou d'autres logiciels malveillants;
Télécharger, publier ou rendre disponible de toute autre manière tout matériel que vous n'avez pas le droit de rendre disponible ou qui enfreint un brevet, une marque de commerce, un secret commercial, un droit d'auteur ou d'autres droits de propriété de toute personne. Vous serez seul responsable de tout dommage résultant de toute violation de la propriété intellectuelle d'un tiers;
Faire une fausse représentation, y compris l'usurpation d'identité de toute personne ou entité ou une fausse déclaration de votre affiliation avec toute personne ou entité;
S'engager dans toute activité qui interfère avec ou perturbe l'utilisation du Réseau, y compris en contournant les mesures que nous pouvons utiliser pour empêcher l'accès non autorisé au Réseau;
Vous engager dans toute activité qui tente d'extraire tout logiciel propriétaire utilisé pour maintenir le Réseau; ou
Suivre, tracer ou récolter toute information sur n'importe quel compte ou toute autre personne qui visite le Réseau.

Vous acceptez que vous êtes seul responsable de (et que nous n'avons aucune responsabilité envers vous ou envers un tiers pour) tout manquement à vos obligations en vertu des présentes Conditions de Service et des conséquences (y compris toute perte ou dommage que nous pourrions subir) de une telle violation. En outre, Physio Connection se réserve le droit d'enquêter, de suspendre et / ou de résilier et de désactiver votre accès au Réseau si vous vous engagez dans l'une des activités ci-dessus, utilisez le Réseau à mauvais escient ou si vous vous engagez dans des actes que Physio Connection considère comme inappropriés ou illégaux.

Vous acceptez qu'aucune adresse courriel trouvée sur le Site ne puisse être collectée ou utilisée à des fins de sollicitation.

Les Services

Sauf indication contraire ou acceptée par Physio Connection par écrit, les Services sont destinés à être utilisés au Canada uniquement. Nous n'assumons aucune responsabilité pour les lois en dehors du Canada régissant l'accès à nos services et si vous les utilisez ailleurs, vous devez vérifier dans ce pays ou cette région qu'il est approprié et permis de le faire. Nous fournissons nos Services conformément à la loi et à la réglementation canadienne, et ne pouvons être tenus responsables des différences entre ces règles et toute autre règle s'appliquant aux services de santé ailleurs.

Vous êtes seul responsable de vous assurer que vous utilisez le Réseau conformément aux présentes Conditions de Service dans la juridiction où vous vous trouvez au moment d'une Consultation et comme le permet la loi ou la réglementation de cette juridiction.

EN SÉLECTIONNANT UNE PROVINCE LORS DE LA PRISE D'UN RENDEZ-VOUS, VOUS CONFIRMEZ QUE VOUS VIVEZ DANS CETTE PROVINCE. Nos Physiothérapeutes sont réglementés au niveau provincial et, à ce titre, ne peuvent fournir des Services de Physiothérapie en Ligne que dans des régions spécifiques. Physio Connection ne sera pas tenu responsable dans le cas où vous induisez ou tentez d'induire en erreur un Physiothérapeute pour qu'il fournisse des Services de Physiothérapie en Ligne dans une province où il n'est pas enregistré. Physio Connection ne vous permettra de prendre rendez-vous avec un physiothérapeute que dans la ou les provinces où il est inscrit. Il vous incombe de fournir des informations exactes lorsque vous prenez un rendez-vous et vous devez sélectionner la province dans laquelle vous vivez.

Nos Physiothérapeutes ont la discrétion de refuser ou d'interrompre la fourniture de Services à tout Utilisateur à tout moment, y compris pour une mauvaise utilisation réelle ou potentielle des Services, notamment à la lumière des présentes Conditions de Service.

Communication avec les employés de Physio Connection et les Physiothérapeutes

Vous reconnaissez et acceptez que vous vous abstiendrez de tout langage ou comportement inapproprié lorsque vous communiquerez avec les employés de Physio Connection et les Physiothérapeutes, indépendamment du fait que ce langage ou ce comportement s'adresse spécifiquement à la personne avec laquelle vous communiquez. Un langage inapproprié comprend, mais sans s'y limiter, les discours abusifs, harcelants, vulgaires, haineux ou diffamatoires, ou qui discriminent d'autres personnes sur la base du sexe, de la race, de la religion, de l'ethnie, de l'orientation sexuelle, de la situation familiale ou du handicap. Vous acceptez également de ne pas tenter de communiquer avec un employé de Physio Connection et les Physiothérapeutes par tout moyen autre que le Réseau, sauf en cas d'accord mutuel ou sur instruction d'un employé de Physio Connection et les Physiothérapeutes.

7. Paiements de frais additionnels et frais d’annulation

Frais additionnels

Vous pouvez accéder et utiliser le Réseau par l’intermédiaire du Site sur un appareil mobile ou par le biais d’un navigateur Web. Vous êtes seul responsable de toutes les exigences logicielles et de tous les frais de données et autres frais associés à l'accès et à l'utilisation du Réseau.

Lorsque vous souhaitez obtenir un Service qui est une Consultation avec un Physiothérapeute, vous et le Physiothérapeute, devrez accepter que cette Consultation établit une relation commerciale directe. Nous faciliterons et traiterons le paiement des Frais applicables pour la Consultation au nom de ce Physiothérapeute. Le paiement des Frais de cette manière est considéré comme étant le même que celui que vous auriez effectué directement audit professionnel.

Si vous payez les Frais pour un Service, vous devez nous fournir des informations de carte de crédit valides comme mode de paiement. Si ce Service est éligible à un reçu d'assurance, nous vous en fournirons un.

Nous ne sommes pas responsables des fluctuations des taux de change ou des frais de traitement facturés par votre fournisseur de paiement ou votre institution financière.

VOUS ACCEPTEZ DE PAYER LE PHYSIOTHÉRAPEUTE POUR UNE CONSULTATION VIA NOTRE RÉSEAU ET VOUS COMPRENEZ QUE VOUS NE PAIEREZ AUCUN PHYSIOTHÉRAPEUTE DIRECTEMENT POUR UNE CONSULTATION. TOUS LES PAIEMENTS DOIVENT ÊTRE EFFECTUÉS PAR L’INTERMÉDIAIRE DE PHYSIO CONNECTION.

Frais d'annulation

Veuillez noter que les annulations ou les reports de rendez-vous effectués jusqu'à quarante-huit (48) heures avant un rendez-vous prévu dans la conversation appropriée seront traités sans pénalité.

Les annulations ou les reports effectués quarante-huit (48) heures ou moins avant un rendez-vous seront assujettis à des frais de 50% des Frais de Consultation.

Physio Connection se réserve le droit d'annuler votre rendez-vous si (i) vous avez plus de 5 minutes de retard, (ii) si votre environnement n'est pas sécuritaire ou privé, ou (iii) si la communication n'est pas sécurisée.

Si vous rencontrez des problèmes techniques avant ou pendant votre rendez-vous, qui vous empêche de vous connecter ou de vous reconnecter, il vous incombe d'envoyer un courriel ou de téléphoner au Physiothérapeute qui vous fournit un Service pour l'informer de la situation. Le Physiothérapeute évaluera la situation et vous indiquera la marche à suivre.

8. Liens vers des site Web tiers et Informations fournis par des tiers

L'utilisation de certains liens sur le Réseau vous dirigera hors du Réseau vers des sites Web tiers. Ces sites Web tiers ne sont pas sous notre contrôle et nous ne sommes pas responsables du contenu d'un tel site Web ou de tout lien contenu dans ce site Web. Les liens tiers inclus sur le Réseau sont fournis pour votre commodité, et l'inclusion de ces liens n'implique pas une recommandation ou une approbation de notre part d'un tel site Web ou des produits ou services qui y sont proposés. Si vous décidez d'accéder à l'un des sites Web tiers, vous le faites entièrement à vos propres risques. Vous reconnaissez et acceptez que nous ne serons pas responsables, directement ou indirectement, de tout dommage ou perte causé ou supposé être causé par, ou en relation avec l'utilisation ou la confiance en ces sites Web tiers.

NOUS NE POUVONS PAS GARANTIR OU REPRÉSENTER, EXPLICITEMENT OU IMPLICITEMENT, QUE LES INFORMATIONS CONTENUES DANS CES PUBLICATIONS SONT EXACTES OU COMPLÈTES.

9. Propriété des droits intellectuels

Le contenu du Réseau comprend, sans s'y limiter, toutes les informations, données, produits, matériaux, services, applications et outils logiciels, éléments de conception, textes, images, photographies, illustrations, contenus audio et vidéo, illustrations et graphiques qui y sont contenus ou autrement mis à votre disposition en relation avec celle-ci (collectivement le « Contenu ») et, à moins que le contexte n'exige clairement le contraire, ou que nous le disions explicitement par écrit, le terme « Réseau» et « Site » comprennent tout le Contenu.

Le Réseau ainsi que toutes les marques de commerce et autres propriétés intellectuelles affichées, distribuées ou autrement rendues disponibles via le Réseau, sont la propriété exclusive de Physio Connection et de ses successeurs, ayants droit, concédants de licence et / ou fournisseurs. Sauf si vous en avez convenu autrement par écrit avec nous, rien dans les présentes Conditions de Service ne vous donne le droit d'utiliser quelconque des Contenus, nos marques de commerce ou toute autre propriété intellectuelle de Physio Connection. Vous ne pouvez céder ou transférer aucun des Contenus et vous ne pouvez pas accorder de licence d'utilisation ou d'accès au Réseau à toute autre partie.

Aucune information ou déclaration contenue dans les présentes Conditions de Service ou du Réseau ne doit être interprétée comme conférant, directement ou par implication, préclusion ou autre, une licence ou un droit en vertu d'un brevet, droit d'auteur, marque de commerce ou autre droit de propriété intellectuelle de Physio Connection ou d'un tiers. Vous ne devez pas modifier, supprimer ou dissimuler les droits d'auteur ou autres avis contenus sur le Réseau, y compris les notifications sur l'un des contenus que vous êtes autorisé à télécharger, transmettre, afficher, imprimer ou reproduire à partir du Réseau.

Toute utilisation non autorisée ou interdite de tout Contenu peut vous exposer à une responsabilité civile, à des poursuites pénales ou aux deux, en vertu des réglementations fédérales, provinciales, étatiques et locales applicables.

Vous ne pouvez pas créer de lien vers le Réseau sans notre autorisation préalable. Nous pouvons toutefois, sur demande, accorder un droit limité et non exclusif de créer un lien vers le Réseau à condition que ce lien soit vers la page d'entrée du Réseau et ne nous représente pas ou l'une de nos activités ou services de manière fausse, trompeuse, péjorative ou autrement négative.

Les droits limités qui vous sont accordés en vertu des présentes Condition de Service peuvent être révoqués par nous à tout moment pour quelque raison que ce soit.

10. Résiliation et annulation

Nous pouvons mettre fin à votre utilisation du Réseau comme envisagé ci-dessus, notamment en cas de violation ou de non-respect par vous des présentes Conditions de Service. Nous pouvons également mettre fin à l'accès aux Contenus, fonctionnalités, produits et services mis à disposition en relation avec ceux-ci, à tout moment et pour quelque raison que ce soit, avec ou sans motif, sans préavis et sans aucune responsabilité.

Si vous souhaitez cesser d'utiliser nos Services, vous pouvez le faire en annulant tout rendez-vous restant que vous pourriez encore avoir, et cesser d'utiliser notre Site ou notre Réseau. Sous réserve des lois applicables et des obligations éthiques et professionnelles du ou des Physiothérapeutes qui vous fournissent des Services de Physiothérapie en Ligne, nous n'aurons aucune autre obligation de quelque nature que ce soit envers vous ou toute autre partie. Nous nous réservons le droit de préserver, de conserver ou de supprimer vos informations, y compris les informations personnelles, conformément à la Politique de Confidentialité et à toutes les lois et réglementations applicables.

11. Exclusion de garantie

CERTAINES PROVINCES ET TERRITOIRES NE PERMETTENT PAS L'EXCLUSION DE GARANTIES (INCLUANT LA PROVINCE DE QUÉBEC). DANS TOUTES LES AUTRES PROVINCES ET TERRITOIRES, SAUF COMME EXPRESSÉMENT FOURNI DANS LES PRÉSENTES, VOTRE UTILISATION DU RÉSEAU VOUS EST FOURNIE «TELLE QUELLE» ET «TELLE QUE DISPONIBLE». NOUS DÉCLINONS EXPRESSÉMENT TOUTES LES AUTRES REPRÉSENTATIONS ET GARANTIES, EXPRESSES OU IMPLICITES, Y COMPRIS, SANS LIMITATION, TOUTES REPRÉSENTATIONS ET GARANTIES DE QUALITÉ MARCHANDE, D'ADÉQUATION À UN USAGE PARTICULIER, DE TITRE OU DE NON-CONTREFAÇON OU TOUTE AUTRE GARANTIE D'UTILISATION, DE PERFORMANCE OU D’USAGE COMMERCIAL. VOTRE SEUL ET UNIQUE RECOURS, ET NOTRE UNIQUE OBLIGATION ENVERS VOUS OU TOUT TIERS POUR TOUTE RÉCLAMATION DÉCOULANT DE VOTRE UTILISATION DU RÉSEAU, EST QUE VOUS ÊTES LIBRE DE CESSER VOTRE UTILISATION DU RÉSEAU À TOUT MOMENT.

12. Limitation de responsabilité

CERTAINES PROVINCES ET TERRITOIRES NE RECONNAISSENT PAS LES EXCLUSIONS DE LIMITATION DE RESPONSABILITÉ POUR TOUS LES TYPES DE DOMMAGES (INCLUANT LA PROVINCE DE QUÉBEC). DANS CES PROVINCES, NOUS SERONS UNIQUEMENT RESPONSABLES ENVERS VOUS DES DOMMAGES DONT NOUS SOMMES EXPRESSÉMENT TENUS POUR RESPONSABLES ENVERS VOUS EN VERTU DE LA LOI APPLICABLE.

DANS TOUT AUTRE CAS, VOUS COMPRENEZ ET ACCEPTEZ EXPRESSÉMENT QUE NOUS NE SERONS PAS RESPONSABLES ENVERS VOUS POUR TOUT DOMMAGE DIRECT, INDIRECT, ACCESSOIRE, SPÉCIAL, CONSÉCUTIF OU EXEMPLAIRE, QUI VOUS SERAIENT CAUSÉ EN LIEN AVEC VOTRE UTILISATION DU RÉSEAU, PEU IMPORTE COMMENT CE DOMMAGE EST CAUSÉ, INCLUANT, MAIS SANS S'Y LIMITER, TOUTE PERTE D'ACHALANDAGE, PERTE DE PROFIT, PERTE D'OPPORTUNITÉS, PERTE DE DONNÉES OU AUTRE PERTE INTANGIBLE. LES LIMITATIONS DE NOTRE RESPONSABILITÉ ENVERS VOUS DANS CETTE SECTION S'APPLIQUERONT PEU IMPORTE SI NOUS AVONS ÉTÉ AVISÉ OU AVONS ÉTÉ CONSCIENTS DE LA POSSIBILITÉ QUE CES PERTES SURVIENNENT OU NON.

13. Connexion

EN AUCUN CAS, PHYSIO CONNECTION NE SERA RESPONSABLE DES RETARDS, INTERRUPTIONS, PANNE DE SERVICE OU AUTRES PROBLÈMES INHÉRENTS À L'UTILISATION D'INTERNET, DE COMMUNICATIONS ÉLECTRONIQUES, DE RÉSEAUX DE TÉLÉCOMMUNICATIONS OU D'AUTRES SYSTÈMES OU RÉSEAUX EN DEHORS DE NOTRE CONTRÔLE RAISONNABLE.

14. Indemnité

Vous acceptez de nous indemniser et de nous tenir, nos sociétés affiliées et leurs agents, employés, administrateurs et dirigeants respectifs, à l'abri de toute réclamation ou demande, cause d'action, responsabilité et dépenses (y compris les honoraires d'avocat raisonnables) dus ou découlant de: i) votre utilisation du Réseau; (ii) votre violation de ces Conditions de Service; (iii) toute fausse déclaration de votre part; ou (iv) votre violation de tout droit d'un tiers en relation avec votre utilisation du Réseau ou des Services.

15. Général

Les présentes Conditions de Service et la Politique de Confidentialité constituent l'intégralité de l'accord entre vous et Physio Connection concernant votre utilisation et notre fourniture du Réseau.

Vous acceptez que nous puissions vous fournir des avis, y compris ceux concernant les modifications des présentes Conditions de Service, par courrier électronique, par courrier ordinaire ou par publication sur le Site.

Vous acceptez que si nous n'exerçons ni n’appliquons aucun droit ou recours légal contenu dans les présentes Conditions de Service (ou dont nous bénéficions en vertu de toute loi applicable), cela ne sera pas considéré comme une renonciation formelle à nos droits, et que ces droits ou recours seront toujours disponibles pour nous.

Si une disposition de ces Conditions de Service est jugée illégale, invalide ou inapplicable, cela n'affectera aucune autre disposition de ces Conditions de Service et l'accord entre vous et nous sera réputé ou modifié dans la mesure nécessaire pour le rendre légal, valide et exécutoire.

Pour demander notre consentement pour l'une des actions pour lesquelles un tel consentement est requis en vertu des présentes Conditions de Service, veuillez nous envoyer un courriel à info@physioconnection.ca. Nous nous réservons le droit de refuser de telles demandes à notre seule discrétion.

17. Loi applicable et juridiction compétente

LES LOIS DE LA PROVINCE DE QUÉBEC ET LES LOIS FÉDÉRALES QUI Y SONT APPLICABLES RÉGIRONT LES PRÉSENTES CONDITIONS DE SERVICE À TOUS ÉGARDS.

VOUS RECONNAISSEZ PAR LES PRÉSENTES QUE LES TRIBUNAUX DE LA PROVINCE OU DU TERRITOIRE OÙ VOUS VOUS TROUVEZ AU MOMENT OÙ LES SERVICES DE PHYSIOTHÉRAPIE EN LIGNE OU LES SERVICES D'ORIENTATION VOUS SONT FOURNIS ONT LA COMPÉTENCE EXCLUSIVE POUR ENTENDRE TOUTE PLAINTE, DEMANDE, RÉCLAMATION, PROCÉDURE OU CAUSE D'ACTION, QUELLE QU'ELLE SOIT, DÉCOULANT DE OU EN RELATION AVEC CES SOINS ET TRAITEMENTS DE PHYSIOTHÉRAPIE OU AUTRES OU LES CONSEILS REÇUS, OU DE TOUT AUTRE ASPECT DE LA RELATION ENTRE VOUS ET LE PHYSIOTHÉRAPEUTE CORRESPONDANT.

TOUTE AUTRE LITIGE RELATIF À CES CONDITIONS DE SERVICE OU L’UTILISATION DU RÉSEAU SERA DE LA COMPÉTENCE EXCLUSIVE DES TRIBUNAUX DE MONTRÉAL, PROVINCE DE QUÉBEC.
